These Terms of Use (“Terms”) govern your use of the Tegaki mobile application (“the app”). By downloading or using the app, you agree to these Terms. If you do not agree, do not use the app.

License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the app in line with the applicable app store’s rules and these Terms.

App store terms

If you obtain the app through the Apple App Store or Google Play, their terms also apply where required (for example payment, refunds, and platform rules).

Acceptable use

You agree not to:

• Use the app in violation of law or third-party rights.
• Attempt to reverse engineer, decompile, or circumvent security of the app except where applicable law forbids this restriction.
• Use the app to distribute malware or interfere with others’ devices or services.

Intellectual property

The app, its branding, and its original content are owned by us or our licensors. Dictionary and stroke data may include third-party materials subject to separate licenses; attribution may appear in-app or in bundled notices.

Disclaimer

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA OR PROFITS, ARISING FROM OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ZERO IF THE APP IS FREE.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

Updates and changes

We may update the app or these Terms. Material changes will be reflected by updating the “Last updated” date. Your continued use after changes may constitute acceptance, as allowed by law.

Termination

We may stop providing the app or suspend access where reasonably necessary. You may stop using the app at any time by uninstalling it.

Governing law

These Terms are governed by the laws of the jurisdiction where the operator of Tegaki is established, excluding conflict-of-law rules that would apply another jurisdiction’s laws. Courts in that jurisdiction have exclusive venue for disputes arising from these Terms, except where mandatory consumer protection law requires that you may bring claims in your country of residence.
